Computer Service Terms

Last updated Oct 22, 2026

These Computer service terms supplement the Terms of Service between Elios Superintelligence, Inc. (“Elios”) and the Customer using Computer. Capitalized terms have the meanings given in the Terms. These terms apply to Computer resources and related storage, templates, snapshots and interfaces to the extent those features are made available to Customer. They do not promise availability of an unreleased feature.

1. Using Computer

Computer provides cloud computing environments that Customer can operate through supported interfaces, including with software agents. Customer may use Computer to develop, test and operate its own applications, and to provide functionality to its own end users, subject to the Agreement. Customer does not need separate resale permission merely because its application uses Computer as infrastructure. Sharing or transferring an Elios account or credentials, or selling access to an account as a separate product, requires Elios’s written approval.

Customer controls the tasks, commands, code, credentials, applications and external services it connects to a computer. Customer must have the rights and permissions needed for those activities, including permission to access third-party systems. Elios’s provision of a browser, terminal or agent interface does not grant permission from a third party or override that party’s terms.

2. Agent actions and external effects

An agent can cause changes outside its Computer environment, including sending messages, changing files, spending money, submitting forms and using third-party accounts. Customer is responsible for configuring its agents and choosing appropriate permissions, approvals, spending controls and supervision for its use case.

Customer must protect credentials and secrets it places in an environment, and revoke credentials when appropriate. Customer must not assume that closing a browser window, disconnecting a client or ending a model conversation stops an agent, releases a resource or revokes its access. The documented resource state and the actual action requested through the supported interface determine whether a resource continues operating.

These responsibilities do not remove Elios’s own obligations under the Agreement, including its confidentiality, security and data processing obligations. The Acceptable Use Policy applies to activity performed by Customer’s software and agents.

3. Customer software and third-party licenses

Customer remains responsible for the software it installs and the content it makes available through Computer, including applicable software licenses, export restrictions and third-party account permissions. Software supplied with a template may carry separate license terms. Open-source permissions and mandatory license conditions continue to apply to the relevant component.

Customer must not remove notices or bypass technical licensing controls in third-party software. Elios does not represent that a general-purpose environment is licensed or configured for every third-party application or regulated workload.

4. Templates, images and sharing

Customer retains its rights in templates, images, code and other Customer Content it creates or uploads. Customer grants Elios the limited rights needed to store, copy, load, execute and deliver those materials to provide the Services under the Agreement.

Sharing permissions must be selected through an available sharing feature or agreed in writing. Uploading a private template alone does not authorize Elios to publish it, add it to a public catalog or use it in marketing.

Templates Customer creates are private to Customer’s organization. Before choosing to share a template or image, Customer must remove credentials, personal data and material it has no right to distribute. Elios does not obtain a broader distribution license merely by describing a resource as a template.

5. Resource states and retained data

Resource names such as running, stopped, paused, suspended or deleted describe the behavior stated in the current product documentation. They do not by themselves establish that all storage, network services, snapshots or other associated resources have been released.

Customer must use the supported deletion and release controls for resources it no longer wants. Retained storage and other provisioned resources may continue to incur disclosed charges after compute execution stops, as specified in the Billing and Metering Policy.

Computers, disks, templates and their backups are stored in data centers in the European Union operated by Hetzner Online GmbH. When Customer deletes a computer, disk or template, Elios purges it within 30 days, and backup copies roll off within 35 days.

Unless expressly included in an Order or documented service feature, Computer is not a backup or disaster recovery service. Customer should maintain independent copies of data it needs to retain. Any backup or snapshot feature has only the retention and recovery behavior expressly described for that feature. Elios’s obligations to return or delete personal data remain governed by the Data Processing Addendum where it applies.

6. Usage, limits and pricing

Computer is billed according to the applicable rate card or Order and the Billing and Metering Policy. The rate card must identify the resource, unit, billable state and metering method. A price calculator is an estimate based on selected inputs unless Elios expressly issues a binding written quote.

Limits on concurrency, resource sizes, duration, networking and API calls are the limits shown for Customer’s account or agreed in an Order. Published availability of a configuration does not reserve capacity unless Elios expressly agrees to a reservation. Customer must not evade technical limits by multiplying accounts or concealing usage.

Elios will address changes to pricing, material functionality and limits under the notice and change provisions of the Terms. An emergency restriction or suspension is governed by the Terms and the Acceptable Use Policy.

7. Isolation and shared responsibility

Each computer runs in an isolated sandbox, as described in the Security Measures. Elios is responsible for the infrastructure and controls it undertakes to provide under the Agreement. Customer is responsible for its application configuration, exposed endpoints, installed software, credentials and permitted user access. An isolated compute environment does not make all software running inside it safe or prevent every external action by that software.

Contractual security commitments are those expressly included in the Agreement and applicable DPA security schedule. General architecture descriptions do not themselves add an uptime guarantee, certification or a promise that a workload cannot be compromised. Nothing in this paragraph limits mandatory rights or excuses an inaccurate representation.

8. Ending use

Customer may stop using Computer by stopping and releasing the resources it no longer requires through the supported controls. Account termination, outstanding charges, data export and deletion are governed by the Terms and applicable DPA. Customer should export required data before deleting a resource or ending its account.

Questions about Computer or a charge can be submitted through Support.
